Houseowner fined for neglecting Cheadle Hulme property

Anthony Boyd, the owner of an empty house at 33 Swann Lane in Cheadle Hulme, was fined £400 and ordered to pay Stockport Council's prosecution costs of £336 for neglecting his property.
Mr Boyd pleaded guilty at Stockport Magistrates on 3rd June 2009.
Mr Boyd bought the property as an empty house and applied for planning permission to demolish it and build a new property on the site.
The property is situated within a Conservation Area and considered by the Council to be a good example of the houses in the area and an important part of the area's character.
While the planning application and subsequent appeal against the Council's
refusal of planning permission was considered, Mr Boyd failed to carry out
any maintenance on the property. The Council felt that it detracted from the
character and appearance of the Conservation Area and caused a loss of
visual amenity to occupiers of nearby houses.
The Council served a formal notice under the Town & Country Planning Act
1990 on Mr. Boyd which required him to repair the boundary fence, remove
graffiti, remove rubbish from the land, and ensure that the house was
secure.
Mr. Boyd failed to comply with this notice leading to the prosecution.
Steve Lamb, the Council's Head of Development & Control, said: "Owners of
land and buildings have a duty to maintain them in a condition where it does
not cause a loss of amenity to occupiers of nearby houses or the general
area. Mr Boyd allowed this property to deteriorate to a point whereby it was
causing serious harm, leading to the action taken by the Council. He then
failed to comply with the notice leading to his conviction and fine."
* Mr Boyd's appeal against the refusal of planning permission was dismissed
