Prenuptial Agreements To Become Legal

New proposals being introduced by the Law Commissioner are set to try “prenuptial agreements in law”. This would hopefully have the aim of reducing the number of Court battles between divorcing couples. Changes are set to revolutionise the divorce process in England and Wales so that couples are able to safeguard their assets in the event of a relationship breakdown. The plans follow three years of consultation by the Law Commission.
Resolution, a national organisation of family lawyers committed to non confrontational divorce, has long argued for a move that will put the legality of prenuptial agreements “beyond doubt”. The current situation is often confusing for both divorcing couples and family lawyers alike.
“We welcome the proposals and hope that this will reduce the need for acrimonious legal proceedings when couples divorce.”
The commission is set to recommend safeguards to ensure that any prenuptial agreements are fairly drafted such as recommending that both parties take independent legal advice from the time of drawing up any agreement.
